Nothing on the Site guarantees availability for a particular date, time, provider, or service. Any appointment or service is subject to scheduling availability, confirmation by our office, and any applicable intake or consent requirements.
The Site and Services are not intended for medical or dental emergencies.

Do not use the Site to request emergency care or to send time-sensitive information. Communications through the Site (including forms or email links) may not be reviewed immediately.

Submitting a form or request through the Site does not create a provider-patient relationship and does not guarantee an appointment.
A provider-patient relationship is established only when:
– our office confirms an appointment, and
– applicable intake and consent processes are completed, and
– the provider determines they can appropriately treat you.
We may decline requests for any lawful reason, including if the requested service is not appropriate, not available, or outside our scope.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
– Provide false, inaccurate, or incomplete information
– Interfere with or disrupt the Services or servers
– Upload, transmit, or introduce malware, viruses, or harmful code
– Use scraping, bots, or other automated means that place an unreasonable burden on the Services

If you opt in, you may receive SMS/MMS messages related to your inquiry or care, including appointment confirmations, reminders, scheduling updates, and administrative messages. Frequency may vary.
Opt-Out: Text “STOP” to cancel anytime. A confirmation may be sent via SMS.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Mobile Information Safeguard:
No mobile information will be shared with third parties or affiliates for marketing/promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties except as necessary to provide the messaging service (for example, SMS platform providers/aggregators).
Your use of the Site is also subject to our Privacy Policy. If you are a patient, certain information may be considered Protected Health Information (PHI) and is handled in accordance with our HIPAA Notice of Privacy Practices. Copies are available at our office and on our website.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YSFD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED $100.

You agree to defend, indemnify, and hold harmless YSFD and its owners, providers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:

– Your violation of any rights of a third party
We may modify, update, or discontinue the Services at any time. We may also update these Terms. The updated version is effective when posted on the Site with a new Effective Date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts.
Severability: If any provision is held invalid, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a corporate transaction.
Entire Agreement: These Terms constitute the entire agreement between you and YSFD regarding the Services.
